Burnley win legal victory over Everton and claim millions in damages

Burnley secured an important legal victory over Everton. It's not on the field, but off it: An independent commission has ruled that Everton must pay the club for breaching the Premier League's Profitability and Sustainability (PSR) rules. Everton have announced an immediate appeal.

The case was discussed in relation to the 2021/22 season. At the time Everton were four points clear of Burnley and stayed in the Premier League, but Burnley were relegated. Later, Everton were found to have breached financial rules. In the 2023/24 season, the club received a 6 point penalty. Burnley claimed that Everton had an advantage in the game due to the infringement and that, had it not been for the infringement, Burnley should not have gone down.

This relegation saw Burnley lose television revenue, sponsorship revenue and other income. According to English media, the club is expecting a loss of around £60m. With this, more than 70 million Euros. The extent of the loss has not yet been announced.

Everton reacted strongly against the ruling. 'The club is shocked and outraged by the Premier League Independent Commission's decision to award Burnley damages for breaching the PSR in June 2022 against Everton,' the club said in a statement. 'This ruling is based on the fact that our financial rules can be breached at any time, creating a dangerous and unworkable precedent for English football.' The club hopes to appeal. 'Everton said the commission's decision misrepresented the clear evidence provided by our legal representatives and the appeal will be successful.'
